DESCRIPTION:Venue\nMaitland Chambers and by Zoom\nTime:\n\n 	Registration 5.30pm\n 	Start 6pm\n 	Reception 7pm\n\nSpeakers\nNicholas Trompeter KC\, Selborne Chambers and James McCreath\, Wilberforce Chambers\n\nExperts’ and Counsel’s duties\n\nTwo important themes in civil litigation generally in recent years have been a reiteration of the importance of the independence of experts\, and a desire to confine within strict boundaries the involvement of lawyers in the production of evidence.  This seminar considers the extent to which it is desirable and permissible for Counsel (and the legal team more generally) to be involved in the production of expert evidence\, and the steps available if a party gets it wrong.  In particular\, we will consider the nature of experts’ duties\, the nature of Counsel’s duties with respect to the production of that evidence\, whether the rules applicable at the joint statement stage differ\, and what procedural steps are available when the mark is overstepped.\n\nNick Trompeter KC is a commercial chancery practitioner at Selborne Chambers. He is a former recipient of ‘Real Estate’ junior of the year in both The Legal 500 Awards and the Chambers UK Bar Awards. Before taking Silk in 2021\, he was on the Attorney-General’s C and B Panels of Counsel. He is recognised in the legal directories as a Silk in Commercial Chancery Litigation\, Real Estate / Property Litigation and Professional Negligence.\n\nJames McCreath is a junior at Wilberforce Chambers\, where property litigation forms a major part of his practice.  Among his highlights of recent years were appearances in the Supreme Court in the Alexander Devine case on the public interest ground under s.84 and the Manchester Ship Canal litigation about the actionability of allegedly polluting sewage discharges.  He is recommended in the directories for Property Litigation\, Commercial Chancery Litigation\, and Pensions.
