The Law Commission has announced radical new proposals to improve the process of enfranchisement of leasehold houses, giving leaseholders greater security and control over their homes. The Commission is considering a range of measures, including options for reducing the price payable for the freehold; introducing an alternative right to a lease extension; making the enfranchisement procedure simpler to understand and potentially abolishing the requirement for leaseholders to contribute to their landlord’s legal costs.
The proposed solutions for leasehold houses may be found on the Law Commission's website and a consultation paper will be published shortly to address wider issues in the law of enfranchisement, for both houses and flats.
The Property Bar Association is very pleased that Professor Hopkins and others from his team will be sharing their thoughts with the Association and inviting our views. This is an opportunity for members to participate in the law reform process at an early stage, and we expect a lively discussion!
