Mr Gavin Bennison

Barrister

Introduction

I practise in all areas of commercial and residential landlord and tenant and real property law. I have been involved in cases concerning (amongst other areas) adverse possession, forfeiture, marine rights, agricultural tenancies, collective enfranchisement, the right to manage, easements, restrictive covenants, mortgages, overage and land registration.

Led by Janet Bignell QC, I appeared as a second six pupil in the Chancery Division on two occasions in Ineos Upstream Ltd & Ors v Persons Unknown (28 July and 12 September 2017), successfully obtaining and continuing a wide-ranging injunction restraining unlawful activities by protestors against hydraulic fracturing (‘fracking’) on a quia timet basis. The injunction was novel in prohibiting unlawful protest targeted at the applicants’ suppliers and associates. The case will return to the Chancery Division for a further, three-day hearing commencing on 31 December 2017.
